Terms of Service

Welcome to ParkLocal. These Terms of Service (“Terms”) govern your use of the ParkLocal mobile application (“App”) operated by ParkLocal (“we,” “our,” or “us”). By using the App, you agree to these Terms.

1. About ParkLocal

ParkLocal is a marketplace that connects people who have available parking spaces (“Hosts”) with people looking for parking (“Drivers”). We provide the platform to facilitate these connections but do not own, manage, or operate any parking spaces.

2. Eligibility

You must be at least 18 years old and have a valid driver’s license (for Drivers) or legal authority over the parking space (for Hosts) to use ParkLocal. By creating an account, you represent that you meet these requirements.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials
You must provide accurate and up-to-date information
You may not create multiple accounts or share your account
You must notify us immediately of any unauthorized use of your account
You can delete your account at any time through the App’s Profile screen

4. For Hosts

By listing a parking space on ParkLocal, you represent and warrant that:

You have the legal right to rent the parking space (as owner, tenant with subletting rights, or authorized representative)
The listing information, including photos, pricing, and availability, is accurate
The parking space is safe and accessible as described
You comply with all local municipal bylaws and regulations regarding parking rentals in your area
You are responsible for reporting any income earned through ParkLocal for tax purposes

5. For Drivers

By booking a parking space through ParkLocal, you agree to:

Use the parking space only during your reserved time period
Follow any special instructions provided by the Host
Leave the parking space in the same condition as you found it
Not use the space for any illegal activity or for storing items other than a vehicle
Vacate the space by the end of your booking period

6. Bookings and Payments

All payments are processed securely through Stripe. When you book a parking space:

The total amount includes the parking fee plus a 12% service fee charged to the Driver
Hosts receive their payout after a 15% platform fee is deducted from the parking fee
Payouts to Hosts are processed through Stripe Connect and typically arrive within 2-3 business days after the booking is completed
All prices are in Canadian Dollars (CAD)

7. Cancellation Policy

More than 48 hours before start time: Full refund to the Driver
Within 48 hours of start time: No refund. The Host has reserved the space and cannot re-list it on short notice
No-shows: No refund

Refunds, when applicable, are processed through Stripe and may take 5-10 business days to appear on your statement.

8. Prohibited Conduct

You agree not to:

Provide false or misleading information in listings or account details
Use the App for any illegal purpose
Circumvent the App’s payment system to arrange bookings directly
Harass, threaten, or discriminate against other users
Post offensive, inappropriate, or fraudulent content
Attempt to access other users’ accounts or our systems without authorization
Use the App to spam or send unsolicited communications

9. Listing Approval

All new listings are subject to approval by ParkLocal. We reserve the right to reject, suspend, or remove any listing that violates these Terms, appears fraudulent, or does not meet our quality standards.

10. Liability and Disclaimers

ParkLocal is a marketplace platform. We do not own, operate, or inspect parking spaces listed on the App. Therefore:

We are not responsible for the condition, safety, or legality of any parking space
We are not liable for any damage to vehicles, personal injury, theft, or other loss that occurs at a parking space
We are not responsible for disputes between Hosts and Drivers
The App is provided “as is” without warranties of any kind

You use ParkLocal at your own risk. We strongly encourage Hosts to maintain appropriate property insurance and Drivers to maintain vehicle insurance.

11. Dispute Resolution

If a dispute arises between a Host and a Driver, we encourage both parties to communicate through the App’s messaging system to resolve the issue. ParkLocal may, at its sole discretion, mediate disputes but is not obligated to do so.

12. Intellectual Property

The ParkLocal name, logo, and App design are our intellectual property. Content you submit (such as listing photos and reviews) remains yours, but you grant us a license to display it within the App for the purpose of operating the service.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our sole discretion. You may delete your account at any time through the App. Upon termination, your right to use the App ceases immediately.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
